N10 Form Ontario — Agreements for Above-Guideline Rent Increases
The N10 form is an agreement between landlord and tenant for a rent increase above Ontario's annual guideline in specific permitted situations.
This is not simply a notice. It is an agreement requiring consent.
When Should You Use an N10?
The N10 may apply when:
- New services are added to the unit
- New amenities are introduced
- Significant capital improvements justify an agreed increase
Example of Proper N10 Use
A landlord installs new in-suite laundry and upgraded parking facilities.
The tenant agrees to an above-guideline increase using an N10 agreement.
When Should You NOT Use an N10?
Do not use an N10 when:
- The tenant does not voluntarily agree
- The increase is a standard annual guideline increase
- You are trying to bypass normal rent control rules
Example of Incorrect N10 Use
A landlord attempts to pressure a tenant into signing an N10 for a routine annual increase.
That is not the intended purpose of the form.
