N5 Form Ontario — Damage, Disturbance and Interference Issues
The N5 form is used when a tenant substantially interferes with the reasonable enjoyment of the property, causes damage, or disrupts other tenants.
This form is commonly used in situations involving excessive noise, property damage, aggressive behaviour, repeated disturbances, and safety concerns.
When Should You Use an N5?
Use an N5 when the issue involves conduct or behaviour rather than unpaid rent.
Example of Proper N5 Use
Multiple tenants complain about loud parties occurring every weekend late into the night.
The landlord documents the incidents and serves an N5 describing the disturbances.
When Should You NOT Use an N5?
An N5 should not be used for:
- Non-payment of rent
- Persistent late payment alone
- Mutual agreements to end tenancy
- Rent increases
Example of Incorrect N5 Use
A landlord serves an N5 because the tenant paid rent late twice.
Late payment issues are generally handled using other forms such as an N8 or N4.
Common N5 Problems
Landlords often run into problems because they:
- Using emotional or vague language in descriptions
- Failing to include specific dates and incidents
- Lacking supporting documentation
- Not clearly describing the nature of the interference
Clear factual detail is extremely important when completing an N5. Each incident should be described with a date, time, and specific details of what occurred.
