N8 Form Ontario — Persistent Late Payment Guide
The N8 form is commonly used when tenants repeatedly pay rent late, even if the full balance is eventually paid.
Unlike the N4, which focuses on unpaid rent, the N8 focuses on an ongoing pattern of late payment.
When Should You Use an N8?
An N8 may be appropriate if:
- Rent is consistently late month after month
- There is a documented payment pattern
- Ongoing payment reliability is a persistent problem
Example of Proper N8 Use
A tenant pays rent 10 to 15 days late almost every month for over a year.
Even though rent is eventually paid, the landlord may choose to serve an N8 based on the repeated pattern.
When Should You NOT Use an N8?
Do not use an N8 when:
- Rent is currently unpaid in full and immediate arrears action is required
- The issue involves property damage or misconduct
- There is only one isolated late payment
Example of Incorrect N8 Use
A tenant pays rent late one time after a banking issue.
A single isolated incident is generally not what the N8 is designed for.
